ARTICLE 2 – SUBJECT
The subject of this agreement is the sale and delivery of the product(s), whose specifications and sales price are provided below, ordered by the BUYER electronically from the website splitcarepro.com belonging to the SELLER. This agreement is drawn up in accordance with the provisions of the Law No. 4077 on Consumer Protection and the Regulation on Distance Contracts to determine the rights and obligations of the parties.

ARTICLE 4 – GENERAL PROVISIONS
4.1- The BUYER acknowledges having read and accepted the preliminary information regarding the product's basic features, price, payment method, and delivery details provided on the website and confirms this electronically.
4.2- The product subject to the contract shall be delivered to the BUYER or the person/institution at the address indicated by the BUYER within the period specified in the preliminary information, depending on the distance to the BUYER's location, and not exceeding the legal maximum of 3 days.
4.3- If the product is to be delivered to a person/institution other than the BUYER, the SELLER shall not be responsible for refusal of delivery by the receiving party.
4.4- The SELLER is responsible for delivering the product in a sound, complete manner, in accordance with the specified specifications and with any applicable warranty certificates and user manuals.
4.5- For the delivery of the product, this agreement must be signed and delivered to the SELLER, and the payment must be completed through the method chosen by the BUYER. If payment is not completed or is cancelled in the bank records, the SELLER is released from the obligation to deliver the product.
4.6- If, after the delivery of the product, the BUYER’s credit card is used unlawfully by third parties through no fault of the BUYER, and the payment is not made to the SELLER by the bank, the BUYER is obliged to return the product to the SELLER within 3 days. Return shipping costs in this case belong to the BUYER.
4.7- In cases of force majeure or extraordinary events such as adverse weather or transportation interruptions, which prevent timely delivery, the SELLER must inform the BUYER. The BUYER may then choose to cancel the order, request a replacement product, or delay delivery until the issue is resolved. In case of cancellation, the payment shall be refunded to the BUYER within 10 days.
4.8- Defective or faulty products covered or not covered by warranty may be sent to the SELLER for repair, and in such cases, the shipping costs shall be borne by the SELLER.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the contract within 7 days from the date of delivery of the product to them or to the designated address. To exercise this right, the BUYER must notify the SELLER via fax, email, or phone within this period, and the product must be unused and in compliance with the conditions outlined in Article 6. In case of withdrawal, the invoice and delivery note must be returned. Upon receipt of these documents, the product cost will be refunded within 7 days. If the invoice is not sent, VAT and other legal deductions cannot be refunded. The return shipping cost will be covered by the SELLER.
ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The right of withdrawal cannot be exercised for:

Products that are not suitable for return due to their nature,

Single-use products,
-
Software and programs that can be copied,
-
Perishable goods or products with expired shelf life.
The following items can only be returned if unopened, undamaged, and unused:

Portable computers (returns are not accepted if the original operating system has been installed),

All types of software and programs,
-
DVDs, VCDs, CDs, and cassettes,
-
Printer and stationery supplies (e.g., toner, cartridges, ribbons),
-
All types of cosmetic products,
-
Mobile phone credit orders.
ARTICLE 7 – COMPETENT COURT
For the implementation of this agreement, Consumer Arbitration Committees and Consumer Courts in the location of the BUYER or SELLER are authorized up to the value announced by the Ministry of Industry and Trade.
By placing an order, the BUYER is deemed to have accepted all terms of this agreement.
